These General Conditions of Sale (hereinafter “GCS”) govern all sales of products made through the online store operated by SHIDO ATELIER (hereinafter “the Seller”) accessible at the website address indicated at the time of order. By placing an order, the buyer (hereinafter “the Customer”) acknowledges having read and accepted these conditions in their entirety.

2. PRODUCT DESCRIPTIONS & PRICING

2.1 Product Descriptions

The products offered for sale are described and presented with the greatest possible accuracy. However, minor variations in colour, texture, or appearance may occur due to display settings, photographic lighting, or the handmade nature of certain items. The Customer acknowledges that the images and descriptions on the website are indicative and may not constitute an exact representation of the product received. Product specifications, including materials, dimensions, and weight, are provided in good faith but may be subject to minor variations inherent in manufacturing processes.

2.2 Pricing

All prices displayed on the website are stated in US Dollars (USD) and include all applicable taxes (TTC — Toutes Taxes Comprises), including VAT at the rate in force at the date of the order where applicable. The VAT rate applied is the rate applicable in metropolitan France unless otherwise specified. Any currency conversion fees applied by the Customer's bank or payment provider are the sole responsibility of the Customer. Prices do not include shipping costs, which are calculated and displayed separately during the ordering process before the Customer confirms their purchase.

The Seller reserves the right to modify prices at any time. However, products will be billed at the price in effect at the time the order is confirmed. Products remain the property of the Seller until full payment has been received, in accordance with the provisions of Articles L.611-1 et seq. of the French Commercial Code relating to retention of title.

3. ORDERING PROCESS

The Customer may place an order through the online store by following these steps:

  • Browse the catalogue and select desired products;
  • Add products to the shopping cart;
  • Review the cart contents, quantities, and total price including shipping;
  • Provide or confirm delivery address and contact information;
  • Select a shipping method;
  • Choose a payment method and complete payment;
  • Confirm the order.

Upon successful order placement, the Customer will receive an order confirmation by email at the address provided during checkout. This confirmation will include a summary of the order, the total amount charged, and an estimated delivery timeframe. The order is only considered accepted upon dispatch of this confirmation email. The Seller reserves the right to cancel or refuse any order from a Customer with whom a dispute exists or where there are reasonable grounds to suspect fraud, in accordance with Article L.221-13 of the French Consumer Code.

The contract is concluded in the English language. These GCS are drawn up in English but are governed exclusively by French law, as set out in Section 10 below. The Customer may save or print these conditions at any time. In accordance with Article L.221-5 of the French Consumer Code, the essential characteristics of the products, the total price, and these conditions are made available to the Customer prior to the conclusion of the contract.

4. PAYMENT METHODS

Payment is due in full at the time the order is placed. The following payment methods are accepted:

All transactions are processed through a secure payment system. The Seller does not store credit card information on its servers. Payment is deemed effective upon confirmation by the Seller’s payment provider. In the event of payment failure, the order will not be processed. The Seller reserves the right to suspend or cancel any order for which payment has not been received in full, in accordance with applicable law.

5. RIGHT OF WITHDRAWAL

In accordance with Article L221-18 of the French Consumer Code (Code de la consommation), the Customer has a period of fourteen (14) calendar days from the date of receipt of the product to exercise their right of withdrawal, without having to provide a reason or pay a penalty.

The Customer may use the model withdrawal form provided below, or may send a clear and unambiguous statement of their decision to withdraw to: support@shidoatelier.com.

5.1 Withdrawal Procedure

To exercise the right of withdrawal, the Customer must notify the Seller of their decision by sending an email to support@shidoatelier.com, including the order number and a statement of withdrawal. The Customer must then return the product(s) within fourteen (14) days of communicating their decision to withdraw. 5.2 Exceptions to the Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal may not be exercised for:

  • Goods made to the Customer’s specifications or clearly personalised;
  • Goods which are liable to deteriorate or expire rapidly;
  • Sealed goods which have been unsealed after delivery and which are not suitable for return due to health or hygiene reasons;
  • Goods which, after delivery, are inseparably mixed with other items.

6. DELIVERY

The Seller undertakes to dispatch orders within the timeframe indicated on the website at the time of purchase. Delivery times are provided as estimates and may vary depending on the destination, the shipping method selected, and the carrier. The Seller cannot be held liable for delays caused by the carrier, customs processing, or force majeure events. In accordance with Article L.216-1 of the French Consumer Code, if the ordered goods are not delivered within thirty (30) days of the expected delivery date and, where applicable, an additional period of thirty (30) days after the Customer has formally requested delivery, the Customer may cancel the order by registered letter with acknowledgment of receipt and obtain a full refund. Risk of loss and damage to the goods passes to the Customer upon delivery. The Customer is advised to check the condition of the parcel upon receipt and to note any damage on the delivery note before signing. Any anomaly must be reported to the Seller within forty-eight (48) hours of receipt.

7. LIABILITY LIMITATIONS

The Seller’s liability is limited to the amount of the order in question. The Seller shall not be held liable for indirect damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or any other consequential loss arising from the use or inability to use the products purchased.

The Seller shall not be held liable for failure to perform its obligations in the event of force majeure, as defined by Article 1218 of the French Civil Code, or in the event of an act of a third party. The Seller is not responsible for the content of external websites linked from the store and makes no guarantee regarding their availability or accuracy.

Nothing in these conditions shall exclude or limit the Seller’s liability for death or personal injury caused by negligence, fraud, or for any other matter for which it would be unlawful to exclude or limit liability under applicable law, including the mandatory provisions of the French Consumer Code.

8. DISPUTE RESOLUTION

In the event of a dispute arising from the interpretation or execution of these General Conditions of Sale, the Customer is invited to contact the Seller in the first instance by email at support@shidoatelier.com in order to seek an amicable resolution.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, the Customer may recourse to a consumer mediation procedure free of charge. The appointed mediator is:

The Customer may also use the European Online Dispute Resolution platform, accessible at https://ec.europa.eu/consumers/odr, to submit a complaint. Referral to the mediator may only be made after an initial written complaint to the Seller has remained unresolved for a period of sixty (60) days. The mediation procedure does not prejudice the Customer’s right to bring legal proceedings.

9. DATA PROTECTION

The Seller collects and processes personal data in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and the French Data Protection Act (Loi Informatique et Libertés). For full details on how personal data is collected, used, stored, and protected, including the Customer’s rights of access, rectification, erasure, and portability, please consult our Privacy Policy.

Personal data collected during the ordering process is necessary for the execution of the contract and the management of the Customer relationship. The Customer’s data will not be shared with third parties without explicit consent, except where required by law or necessary for the execution of the order (e.g. shipping carriers).

10. APPLICABLE LAW & JURISDICTION

These General Conditions of Sale are governed by and shall be construed in accordance with French law. In the event of a dispute, and after the mediation procedure described in Section 8 has been attempted, the competent courts shall be the French courts. Pursuant to Article L.612-1 of the French Consumer Code, the Consumer may also benefit from the conventional mediation procedure for amicable dispute resolution.

For Customers residing outside of France, the applicable mandatory consumer protection provisions of the Customer’s country of residence shall remain unaffected. Any clause of these GCS that is found to be invalid or unenforceable shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

11. INTELLECTUAL PROPERTY

All content on the SHIDO ATELIER online store, including but not limited to text, graphics, logos, icons, images, photographs, audio and video clips, digital assets, designs, logos, trademarks, photographs, illustrations, texts, graphics, user interfaces, visual interfaces, and the general structure of the website, is the exclusive property of SHIDO ATELIER or its licensors and is protected by applicable intellectual property laws, including the French Intellectual Property Code (Code de la propriété intellectuelle).

Any reproduction, representation, modification, distribution, or exploitation of all or part of the content of the website, by any means whatsoever, without the prior written authorisation of SHIDO ATELIER, constitutes an infringement of intellectual property rights and is strictly prohibited. The Customer is granted a limited, non-exclusive, non-transferable licence to access and use the website for the sole purpose of browsing and placing orders.

12. MODIFICATIONS

The Seller reserves the right to modify these General Conditions of Sale at any time. The conditions applicable to the Customer are those in effect on the date the order is placed. The Customer is encouraged to review these conditions periodically. Continued use of the website following any changes constitutes acceptance of the revised conditions.
